1. About BuyMyShine
BuyMyShine operates a peer-to-peer marketplace connecting independent sellers and buyers of pre-owned jewelry. We do not take ownership of jewelry inventory. We facilitate identity verification, professional authentication, secure escrow, and transfer between sellers and buyers. BuyMyShine is not a statutory certification authority. Verification and valuation are conducted through professional assessment and represent our best available evidence, not a legal guarantee of authenticity or value.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use this Platform. Sellers are required to complete identity verification (such as Aadhaar or PAN) before listing an item. Buyers may be required to complete verification for transactions above a certain value.
3. Seller Terms
By listing an item, you confirm that you legally own the item or have the authority to sell it, and that all information provided about the item is accurate and complete to the best of your knowledge. Misrepresentation of an item's authenticity, condition, or ownership may result in removal of your listing, forfeiture of proceeds, and other action available to us under law. Any valuation shown before professional authentication is indicative only. The final price is determined after the item has been authenticated.
4. Authentication Process
Items submitted for sale go through an initial assessment, followed by professional authentication conducted by BuyMyShine or its verification partners. This may involve physical collection of the item for inspection. Once authenticated, the item is listed with a verification record reflecting its assessed characteristics.
5. Buyer Terms
Buyers are entitled to receive the item as represented in its authenticated listing. Payment is held in escrow and released to the seller only once the transaction conditions are met. If an item received does not match its listing, buyers may raise a dispute within [X] days of delivery, subject to our dispute resolution process below.
6. Escrow and Payments
Payments are held in escrow by BuyMyShine or our payment partner until the seller has handed over the verified item and the buyer has confirmed receipt. A commission fee applies to completed transactions, as disclosed at the time of listing or purchase. Refunds are processed in accordance with our dispute resolution process.
7. Logistics and Handling
BuyMyShine may arrange pickup of items from sellers and delivery to buyers as part of the transaction process. Items are insured during transit and handling by BuyMyShine or its logistics partners. We are not liable for loss or damage occurring outside of this custody period.
8. Prohibited Conduct
You agree not to submit fraudulent listings, provide false documentation, misrepresent your identity or ownership, attempt to circumvent escrow or verification processes, or engage in any conduct that harms other users or the integrity of the Platform.
9. Limitation of Liability
To the fullest extent permitted by law, BuyMyShine's liability arising from your use of the Platform is limited to the value of the specific transaction giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
10. Dispute Resolution
If a dispute arises regarding authenticity, condition, or delivery of an item, please contact our support team at [email/contact]. We will investigate and aim to resolve disputes fairly based on the evidence available, including authentication records.
11. Termination
We may suspend or terminate your access to the Platform if you violate these Terms or engage in fraudulent or harmful conduct.
12. Governing Law
These Terms are governed by the laws of India, with courts in Hyderabad, Telangana having exclusive jurisdiction over any disputes.
